Abstract:
Within the topics of the right to privacy of data about pupils/students and their learning, used for learning analytics, this paper deals with the issues of using data obtained from the learning and teaching process. In e-learning systems, detailed records of student progress are kept, so it is logical to apply learning analytics to this data. In this context, issues of their rights are viewed differently according to their age. The quality and reliable adoption of learning analytics also raises the question of the relationship between the various ethical and privacy issues that arise during the data analysis for learning analytics. The use of data to improve learning and teaching is on the rise, but there are still open questions to be debated. These are primarily guidelines related to this issue. In order to gain insight into the opinions of the professionals and scientists, we researched legal regulations and scientific literature. Based on this, we have identified the fundamental guidelines as seen by the legal profession and a list of issues and guidelines discussed in scientific papers, which concern issues of ethics and privacy. In the concluding remarks, we summarized the research findings to better understand the relationship between the various legal, ethical, and privacy issues that arise during the implementation of learning analytics in education.
