Abstract:
The presented paper provides an insight into the issues concerning the position of a person - a child with a disability, who is unable to give a full testimony about his/her experience and perception of the poor quality of the education process he/she is going through due to his/her limitations of mental and voluntary abilities.

In the first part, the paper shows the influence of the Czech legislation (the so-called restriction of legal capacity) on the position of man in the system of (not only) public educational services.

The second part will describe the effects of the described legislation on the position of legal representatives of persons with disabilities (parents as guardians, children as guardians) and especially the impact of the legal and factual situation on the im/possibility of quality evaluation of education services and analogously social or health services.

Finally, we will present the results of qualitative measurement of attitudes of employees in education and their perception of risk factors forming the framework of the "problematic position of the legal representative" as an authorized person to determine the content, scope and evaluate the quality of services provided.

The monitored area is a very risky factor in the development of quality educational services and care in modern societies. It is also significantly related to the level of democracy and understanding of human and civil rights in a vulnerable group of people.
