FROM DIGITAL REGULATION TO DIGITAL GOVERNANCE LITERACY: UNDERSTANDING EMERGING TECHNOLOGIES IN THE EUROPEAN UNION

Abstract:
The governance of emerging digital technologies has become one of the defining policy challenges of the 21st century. In the European Union, the rapid expansion of technologies such as artificial intelligence, distributed ledger technologies, and platform-based ecosystems has triggered an unprecedented wave of regulatory initiatives. However, the empirical reality of implementation remains highly uneven, characterized by institutional fragmentation, asymmetries in administrative capacity, varying levels of expertise, operational inconsistencies, and limited coordination across governance levels.
This paper introduces the concept of Digital Governance Literacy (DGL) as a multidimensional construct situated at the intersection of regulatory, institutional, and strategic innovation capacities. DGL is defined as the ability of institutional actors to understand, interpret, and operationalize digital regulatory frameworks within complex governance environments. The paper argues that the effective implementation of emerging technologies requires reaching a “systemic critical threshold” of literacy across these dimensions, below which digital governance remains fragmented, reactive, and ineffective.
The study employs a comparative policy analysis combined with a qualitative assessment of EU regulatory frameworks, including GDPR, DSA, DMA and the AI Act, supported by secondary data from Digital Decade reports and national strategies. The analysis identifies key knowledge gaps, institutional dysfunctions, and structural barriers that limit the operationalization of digital policies across member states.
Building on these findings, the paper proposes a conceptual instructional design framework aimed at developing Digital Governance Literacy in higher education and professional training contexts. This framework is grounded in the ADDIE model (Analysis, Design, Development, Implementation, Evaluation), which enables a structured and iterative approach to learning design.
In this framework, the Analysis phase focuses on identifying competency needs and knowledge gaps in digital governance; the Design phase defines learning objectives and curricular structures aligned with the three dimensions of DGL; the Development phase involves the creation of educational content and tools, including case studies, policy scenarios, and comparative analyses; the Implementation phase relies on active learning methods such as policy simulations, problem-based learning, and collaborative exercises; and the Evaluation phase ensures continuous assessment and refinement of the learning process.
Due to its cyclical nature, the ADDIE model also reflects the internal dynamics of Digital Governance Literacy development, emphasizing that this competence evolves progressively through iterative processes of learning, application, and evaluation.
Preliminary results indicate that such learning models significantly improve learners’ ability to interpret regulatory frameworks, understand institutional dynamics, and apply innovation-oriented governance approaches. The study concludes that achieving a systemic critical threshold of Digital Governance Literacy through structured educational interventions is essential for bridging the gap between regulatory ambition and the effective implementation of emerging technologies in the European Union.Keywords:
