Abstract:
The use of Information and Communication Technologies (ICT) in the health area has grown in parallel with the advancement of technology. However, this fact reveals a concern with the ethical and legal aspects regarding the handling of clinical images by professionals and health students regarding the capture, storage and dissemination of the image of patients during the teaching and learning process. There is a absence of protocols and / or national guidelines on this topic in the health area, increasing the risks of legal and ethical infractions by the Professional Councils. This work aims to propose a protocol for the use and sharing of patient images, based on the legal and ethical aspects in force in Brazil. The protocol addresses the following issues: Principles of human photography; Photography of children or young people; Photograph of children or young people unable to consent; Adult photography; Photography of adults unable to decide; Photograph of deceased patients; Photographs for secondary purposes; Photographs of patients for public use; Sharing; Storage; and, final provisions. The protocol will allow an advance in the safety of clinical data and in the practice of teaching and learning in the field of health in Brazil, since through these guidelines professionals and academics will be able to understand in a detailed and standardized way the safe ways of using clinical images, in accordance with national legal and ethical provisions, as well as improving safety in obtaining, storing and disseminating clinical images in the teaching and learning process.
