Abstract:
The present research is based on two premises. First, the need that 21st-century university professors are required to adapt our teaching methods to the needs and realities of our students, with the aim of ensuring that they acquire competencies and learning outcomes optimally and efficiently. And, secondly, the challenge imposed by supranational organisations such as the United Nations, the European Union, and the Council of Europe that member states must introduce mediation and other alternative conflict resolution methods in their national legislations, as a way of complementing the justice system, and must offer the possibility for people who have a conflict to resolve it via auto-composition, with or without third-party assistance.
With the legislation currently in force in Spain, talking about university mediation in Spain means associating this tool either with a service or organization of the University, or with the University Ombudsman, who despite the fact that Organic Law 6/2001, of December 21, of Universities allows you to carry out mediation, they cannot always do it because they lack the necessary resources and knowledge. In the event that the conflict can be resolved by the university defender, in most cases the solution involves a conciliation procedure that, although it has the will of the parties in common with mediation, is very different from it. when the third party proposes the solution agreement and not seeking, as a goal, to put an end to the scale of conflict and contribute to the improvement of coexistence.
The objective of this work is to establish how mediation can be used in Spain in two aspects: as an instrument for conflict resolution in the university environment and as a tool to train in the peaceful resolution of conflicts that improves coexistence in the university.
