EDUCATIONAL RIGHTS OF RUSSIAN SCHOOLCHILDREN AND STUDENTS DURING THE PANDEMIC

Abstract:
The pandemic has aggravated not only the problem of the quality of Russian education, but also the situation with the realization of the student's educational rights. For the first time in Russia, students, their parents, and public activists began to claim violations of the educational rights. The purpose of the study was to identify the causes of this situation and to test two hypotheses:
1) it is possible that the pandemic as a litmus revealed the problem of violation of the educational rights, which was formed in the pre-covid period;
2) hypothetically, due to the pandemic, some new prerequisites for violating the educational rights arose.
Research objectives:
1) the analysis of cases of violations of the educational rights of Russian schoolchildren and students during the COVID-19 pandemic;
2) the determination of the causes of violations of the student's educational rights;
3) the identification of the correlation (or lack thereof) of violations of the educational rights due to the pandemic.
The empirical basis of the paper is the data of a sociological study conducted in 2020-2021. The author used the method of documentary analysis (publications of Russian media, content of social networks). The subject of the study was the situation of violations of the educational rights, as well as the actions of students, their parents, and public activists to protect them. An additional research method was the included observation of the behavior of students, parents of schoolchildren, school and university administrations in conflict situations that arose during the pandemic.
Research results:
1. The study revealed an increase in public attention to cases of violations of the educational rights of Russian schoolchildren and students. For the first time in recent years, this situation has received a wide public response due to its discussion on social networks, publications by journalists, and the activation of parent's social movements. Violation of the educational rights has become one of the key causes of conflicts in the education.
2. The author revealed that the most active defenders of the educational rights are the schoolchildren parents. They actively use not only individual strategies to protect the rights of their children in educational organization, authorities, the office of the ombudsman. There is clearly a process of self-organization of parent communities implementing collective strategies to protect children's educational rights.
3. The main reasons for the violation of the educational rights of schoolchildren and students were identified:
1) the unwillingness of educational organizations to maintain the quality of education in distance learning and e-learning;
2) authoritarian method of decision-making on the organization of the educational process during the pandemic without taking into consideration the opinions of students, schoolchildren and their parents;
3) the discrepancy between the quality of educational services and the cost of the contract for training.
It is concluded that the prerequisites for legal conflicts was developed in the pre-pandemic period, but manifested themselves with renewed vigor during the pandemic, which caused public activity to protect the educational rights of schoolchildren and students.Keywords:
